Thetermsofservicestartoutbystating,"Exceptforthelicenseyougrantbelow,youretainallrightsinandtoyourUserContent,asbetweenyouandFaceApp.Further,FaceAppdoesnotclaimownershipofanyUserContentthatyoupostonorthroughtheServices."

Thestatementseemsinnocuousenough,anditsoundsasthoughanyonewhousesFaceAppretainsfullrightstotheircontent.However,the"licenseyougrantbelow"sectionimmediatelydispelsthatnotion.

Thesectiongoesontostate,"YougrantFaceAppaperpetual,irrevocable,nonexclusive,royalty-free,worldwide,fully-paid,transferablesub-licensablelicensetouse,reproduce,modify,adapt,publish,translate,createderivativeworksfrom,distribute,publiclyperformanddisplayyourUserContentandanyname,usernameorlikenessprovidedinconnectionwithyourUserContentinallmediaformatsandchannelsnowknownorlaterdeveloped,withoutcompensationtoyou.ByusingtheServices,youagreethattheUserContentmaybeusedforcommercialpurposes.YoufurtheracknowledgethatFaceApp'suseoftheUserContentforcommercialpurposeswillnotresultinanyinjurytoyouortoanypersonyouauthorizedtoactonitsbehalf."

Essentially,ifyoumakesomethinginFaceApp,FaceAppcandowhateveritwantswithwhatyou'vemade.Notonlycanitrepostyourimageswithoutyourpermission,itcanmonetizetheimages,eitherdirectlyorindirectly,withoutcompensatingyouornotifyingyouthatithasdonesoinanyway.

ThismeansthatwhileFaceAppacknowledgestheydonotownthecontentthattheyarecreating,theyarelegally,perpetually,andirrevocablyallowedtodowhatevertheywantwithsaidcontent.Notonlycantheyusethecontentinwhateverwaytheywant,theyalsostatethatyouwaiveallrightsiftheirusesomehowcausesdamagestoyou.

Inadditiontobeingabletouseyourimageswithoutyourknowledge,FaceApp'stermsgoontostatethattheyhavenoobligationtokeepanythingausercreatesprivate."YougrantFaceAppconsenttousetheUserContent,regardlessofwhetheritincludesanindividual'sname,likeness,voiceorpersona,sufficienttoindicatetheindividual'sidentity."

Thisraisessomeconcerningquestionsovertheabilitytofreelyshowthecontentcreatedbyminorswhomakeupanot-insignificantamountofFaceApp'susers.Minors,duetotheirageandinexperience,wouldnotbeabletoconsenttohavingtheirimagesusedbyFaceApp.Similarly,Amazonhadrecentlyfacedlawsuitsduetomishandlingofminors'data.

Andlastly,FaceApphasincludedasmallsentencethatstatestheyareallowedtostoreyourcontentregardlessofwhetherornotyoudeleteitfromtheirservice.Theystatethatitisinorderto"complywithcertainlegalobligations,"thoughtheydonotgoontodefinewhattheobligationsare.Again,thisisincreasinglyconcerningasdatabreachesarebecomingincreasinglycommon.
